These Terms and Conditions ("Terms") govern your access to and use of the online course "S.O.N.A.R. Guitar System" (the "Course") and all related services, including the free strategy call and the online community, offered by:
Philipp Linke, trading as Phry McDunstan
Bleichstr. 23, 51063 Köln, Germany
Email: [email protected]
("we", "us", "our"). By purchasing the Course or booking a strategy call, you ("Customer", "you") agree to these Terms.
The S.O.N.A.R. Guitar System is an online educational program combining guitar instruction with personal development content, delivered through video lessons and related materials hosted on our course platform (Course Creator 360).
Before purchase, we offer a free, no-obligation strategy call via Zoom to discuss your goals and whether the Course is a good fit for you. Booking a call does not create any purchase obligation.
Upon full or first installment payment, you receive lifetime access to the core Course content, subject to the Course remaining available on our platform. We reserve the right to update, improve, or reasonably modify the content over time.
The personal coaching element included with the Course is provided for twelve (12) months from the date of purchase. After this period, the coaching component ends; access to the core Course content remains lifetime as described above.
Customers receive access to a private community hosted on our course platform (Course Creator 360). Community rules are set out in Section 7 below.
The current price for the Course is USD $599, payable either as:
- a single one-time payment of USD $599; or
- six (6) monthly installments of USD $100 each.
If you choose the installment plan, you agree to pay all six installments; the installment plan is a financing arrangement for the same Course access, not a subscription you can cancel to avoid remaining payments, except as provided in our Refund Policy or applicable law.
As a small business owner under the German small business regulation (§19 UStG - Kleinunternehmerregelung), we do not charge or state German VAT on our prices.
Payments are processed through Course Creator 360 and its integrated payment processing. We do not store your full payment card details ourselves.
We offer a 30-day money-back guarantee, and EU consumers additionally have statutory withdrawal rights. Full details, conditions, and the withdrawal form are set out in our separate Right of Withdrawal / Refund Policy, which forms part of these Terms.
We grant you a personal, non-exclusive, non-transferable license to access and use the Course materials for your own personal, non-commercial learning purposes. You may not:
- share, resell, sublicense, or distribute your access or the materials to any third party;
- copy, record, or reproduce the materials for purposes beyond personal use;
use the materials to create a competing product or service.
All Course content, including videos, worksheets, and branding, remains our intellectual property or that of our licensors.
The Course combines guitar instruction with personal development content. While we believe in the value of this approach, we do not guarantee specific musical, financial, or personal outcomes. Results depend on individual effort, practice, and circumstances. The Course and coaching are educational in nature and are not a substitute for professional medical, psychological, or therapeutic treatment. If you are experiencing a mental health crisis, please seek appropriate professional help.
Access to the private community (hosted on Course Creator 360) is subject to the following rules:
- Treat all members and staff with respect and kindness at all times.
- No self-promotion, advertising, or promotion of third-party products, services, or communities.
- No spam, unsolicited messaging, or repeated off-topic posting.
We reserve the right to remove content or restrict or terminate community access, without refund of the community-access portion of your purchase, if you materially breach these guidelines.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot legally be limited or excluded. Subject to this, our liability for indirect or consequential damages, or for loss of profits, is excluded to the fullest extent permitted by law.
These Terms remain in effect for as long as you have access to the Course or community. We may suspend or terminate your access if you materially breach these Terms, including the Community Guidelines in Section 7.
These Terms are governed by the laws of Germany, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence, which remain unaffected if you are a consumer in the EU, the US, or elsewhere. Any disputes will, where legally possible, be subject to the courts of Cologne, Germany, without prejudice to your right to bring proceedings in your own country of residence as a consumer.
We may update these Terms from time to time. Material changes will be communicated by email or a notice on our platform. Continued use of the Course after changes take effect constitutes acceptance of the updated Terms.
Questions about these Terms can be sent to [email protected].
